LABOUR MARKET IMPACT ASSESSMENT (LMIA) & LMIA – EXEMPT

The standard work permit process is a two-step process as opposed to common belief that people must simply apply for a work permit. In the first step, the employer applies for an LMIA and in the second step, the employee applies for the work permit.

Per IRCC, a Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker. A positive LMIA will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job.

FREE TRADE AGREEMENT – WORK PERMIT

Canada has free trade agreements with certain countries including the United States, Mexico, Chile, Peru, Colombia, and Korea among others. If you are a citizen of one of these countries, and you have a valid job offer in Canada, you may be eligible to apply for an LMIA-exempt work permit. OPEN WORK PERMIT

Unlike a standard work permit, an open work permit is not restrictive to occupation, location or employer. You will not need an LMIA in order to obtain an open work permit.

Some of the eligible candidates for an open work permit are:

  • International students who graduated from a designated learning institution and are eligible for the Post-Graduation Work Permit Program
  • Spouses or common-law partners of international students
  • Refugee, refugee claimant, protected person or their family member
  • Temporary resident permit holder
